Code Enforcement : Nuisances

The Town of Salem investigates complaints of nuisances in accordance with state law (RSA 147). A nuisance may arise from the use of property in an unreasonable manner or activity that results in an unreasonable interference with the use of another’s property. Many types of nuisances may become a public health threat if left uncorrected. Various definitions of nuisance include:

  • That which annoys and disturbs one in possession of his property, rendering its ordinary use or occupation physically uncomfortable to him.

     

  • Everything that endangers life or health, gives offense to the senses, violates the laws of decency, or obstructs reasonable and comfortable use of property.

 

Typical nuisances include issues involving:

 

  • Improper storage and disposal of trash, garbage, yard waste, construction debris, and other types of junk and debris.

     

  • Offensive odors.

     

  • Excessive noise.

     

  • Abandoned or unused swimming pools with stagnant water which may provide a breeding area for mosquitoes.

     

  • Land application of biosolids, also known as sewage sludge.

     

  • Improper discharges from septic systems, holding tanks, sinks, or other types of drains.

     

Nuisance complaints must include the exact location and type of nuisance in order to allow a thorough investigation by the Health Officer. It is helpful if the complainant provides their name and telephone number in order to request additional information, if needed. Please note that complaints will be kept confidential if requested.
